Text messages in a custody or divorce case
Co-parenting texts often end up in front of a family judge. Here is what tends to help, what backfires, and how to turn a thread into a dated record you can stand behind.

Short answer
Family courts can consider text messages if they are relevant and properly presented, and the judge decides how much weight they get. What helps is a complete, dated record tied to real issues such as pickups, school and medical information, or expenses. Keep the whole conversation, include your own messages, and follow the court's directions on what to file and how.

Yes, if they are relevant and properly presented. Courts decide what they will consider and how much weight to give it. In US federal courts, Rule 901 requires showing a record is what you say it is, often through someone who took part in the conversation; family cases are mostly in state courts with their own rules. In England and Wales, the court's directions and Practice Direction 27A govern what goes in the bundle.
What to do with your texts right now
Preserve everything, change nothing
Turn off any auto-delete (on iPhone, Settings › Apps › Messages › Keep Messages › Forever), keep the phone, and do not delete awkward messages. Make a first export now so you have a dated copy.
Export the chat and make a PDF
Use WhatsApp's Export chat, then turn the file into a dated, page-numbered PDF with our free tool. It runs in your browser and uploads nothing.
Print the thread with dates and senders
On a Mac, print the conversation to PDF; on Windows, use a desktop backup tool. Text Records does it on the iPhone.
Start by keeping everything
Answer the two questions for the next step.
Can messages be changed after they are sent?
It matters because the other side may say a message was altered. Each channel leaves different traces.
| Channel | Edit a sent message | Remove a sent message | What the other person sees |
|---|---|---|---|
| iMessage | Yes, up to 5 times within 15 minutes | Yes, with Undo Send within 2 minutes | Both people can tap Edited to see earlier versions; a note shows when a message was unsent |
| SMS, MMS or RCS on iPhone | ✕ | ✕ | Nothing changes after sending |
| Yes, within 15 minutes | Yes, delete for everyone within 2 days | "This message was deleted" replaces a deleted message |

Tie each message to an event
A judge can check events. Put the order, the message and an independent record side by side, one row per event. This example is fictional.
| Date and time | What was scheduled | Messages | What happened | Other record |
|---|---|---|---|---|
| May 6, 3:10 p.m. | Pickup at 5:00 p.m. | #14–#18 | Parent A asked to move to 6:00; agreed 5:30 at 3:24 p.m. | Parenting calendar |
| May 12, 8:05 a.m. | School appointment | #41–#44 | Appointment details sent to Parent B | School email |
| May 18, 5:30 p.m. | Exchange | #63–#67 | Parent B messaged about traffic; arrival logged at 5:52 p.m. | Exchange log |
Write what a message said ("Parent B messaged that traffic caused the delay"), not what you believe happened, unless another record shows it. Message numbers like #14 match the numbers printed in a Text Records transcript.
What to keep
- The full conversation on the phone, including your own messages and attachments.
- Each person's phone number or account, not only the contact name you saved.
- A first export with the date you made it, and the method you used.
- A short timeline of the events that matter, with message references.
- Related records such as the parenting order, school emails, receipts and calendars.
- An unedited master copy. Make highlights and redactions only on a working copy.
- Anything a child sent, kept privately and shared only as the court or professionals direct.
What texts cannot show on their own
- Messages show what was written, not everything that happened or what is best for a child.
- An export cannot show who was holding the phone when a message was sent.
- A handful of angry excerpts can backfire. Courts may ask for the whole conversation.
Turn the thread into a dated transcript
Text Records exports a Messages or WhatsApp chat as a PDF with a sender, date and time on every message and numbered messages you can cite, all on your iPhone.
- Sender, date and time on every message
- Processed on your iPhone, nothing uploaded
- Free to import, review and preview; prices shown before you start
Questions people ask
Are text messages admissible in family court?
They can be, if relevant and properly presented. The court decides admissibility and weight under the rules that apply where the case is heard.
Can you subpoena text messages in a divorce?
A party can sometimes ask for relevant records through the court's discovery or disclosure process. A subpoena cannot create messages that no longer exist, and it can face objections about privacy and scope. Ask a lawyer before sending one.
Should I submit every message?
Usually not. Keep everything, disclose what the rules require, then file the focused material the court's directions allow.
Are screenshots good enough?
For a short exchange they can be, but they often lack exact times and phone numbers. A full export with a sender and time on every message is easier to check. See screenshots vs exports.
May I delete messages that make me look bad?
No. Once a case is pending or likely, deleting relevant messages can seriously harm your case. Ask your lawyer about what you must keep.
